LAW 682I: Discussion: Lawyers in the Age of Trump

This group will discuss the role of lawyers in the context of the controversial and polarizing Trump presidency. We will focus both on dilemmas for lawyers and on some selected substantive legal issues. As we consider topics in the current context, we will do some historical reading as well to place contemporary questions in context. Topics will include the role of lawyers in responding to the Trump immigration policies, from providing crisis advice at airports in winter 2017 through contemporary controversies about family separation; the role of lawyers opposing and supporting Trump on television and in social media; the professional dilemma for progressive lawyers in the federal government about whether to stay or leave; and substantive legal issues that have arisen since Trump took office, such as questions about whether the President can be indicted, the emoluments clause and the 25th Amendment. Begin in Autumn Quarter and run through Spring Quarter. Class will meet five Tuesdays from 7:00 - 9:00 p.m. (precise dates TBD). Elements used in grading: Attendance, Class Participation.
